Use the Court Order for Testing Template

Over the years we have found that many donors show up for testing, but aren't sure what test they need to perform, they are confused about who is supposed to pay for their testing, and may not know who test results should be released to. In addition, some donors may avoid sending test results to specific people who need them, they may purposely misrepresent why they are testing, and may lie to collection site staff about what type of test should be performed. When a court orders an individual to perform testing, we don't know what's contained in that order unless it is sent to us, and even if it is sent to us, the information that we need to make sure testing is done properly and results are reported to those who need to know may be incomplete or in some cases, completely absent.

To help resolve problems with court ordered testing, we collaborated with attorneys and legal experts to create our Court Order for Testing Template. The Court Order for Testing Template is a simple fill-in-the-blank and check box PDF file. The template allows you to order testing for one or more clients with just a few clicks. The template presents testing services that are typically used in legal cases in a "restaurant menu" style. Once the order is filled in, simply print it out and have the judge sign the order. All the legal language necessary for results to be released to your office and other parties necessary is already written out for you.

Select the appropriate test

Making sure that you select the most appropriate test for your client's situation will save you time, and your client money.

It's tempting to ask that a client take the most comprehensive test out there to make sure everything is covered, but not only can this cause your client to pay for testing that they don't need, it may also cause unnecessary confusion if the result comes back positive for a prescription that you were unaware of.

When selecting a drug test, you should consider:

  • How far back in the past do you need to look?
  • What drugs or substances are you concerned about?
  • Are you aware of drug use and looking to monitor it for the foreseeable future?

Tests that look farther back tend to cost more, and the further back you go, the more difficult it may be for your client to provide a sample. Before you order a test, make sure your donor will have enough of a sample to take the test. For example, a person with a shaved head isn't going to be able to take a head hair test, and a person with extremely short finger or toenails probably won't be able to take a nail test. Be prepared for your client to be told to come back weeks, or in some cases, months later.

After you have determined what drugs or substances you are concerned about, you should go with the smallest panel offered that will cover these items. There's no reason to test for something if it's not a concern.

If you are aware that a client has been using a substance and you are going to be ordering ongoing testing, make sure you pick a test that will cover the necessary time period between tests and is cost efficient for your client.

Don't worry if you get confused or overwhelmed, there are quite literally tens of thousands of forensic tests out there for countless different drugs and a multitude of laboratory tests for different reasons. Make sure your client understands any payment arrangements before making appointments or showing up for testing

One of the most frustrating situations for donors to be in is showing up for testing only to find out that the party responsible for making payment hasn't done so; this is especially true when they have taken time off of work or made special arrangements for transportation or childcare.

In some situations, attorneys will agree that each party is responsible for paying for the opposing parties test and vice versa. While this may seem like a good idea, it frequently causes issues when one party delays payment or refuses to make payment. In those situations, testing can come to an impasse, and delays are all but inevitable. These problems can easily be avoided by having each party pay for their own testing. Other arrangements, such as one party reimbursing the other after testing is complete, is much easier to handle after testing has concluded. If you find yourself in a situation where you need to have opposing parties pay for each other's testing, it is extremely important that all parties understand who is paying for what and when that payment is expected to be made.

Make sure your client knows that before they make an appointment or arrive for testing, they can call our office to verify that payment has been made for their test and that it will be available when they arrive for testing. This can help prevent problems and make the entire testing process less stressful for your client.

Another important thing to let your client know is what payment methods we accept. Payments can be made in any of the following ways:

  • In person with cash, cashier's check, money order, or a Visa® or MasterCard® branded credit or debit card.
  • Over the phone with a Visa® or MasterCard® branded credit or debit card.

Prepaid gift cards are not accepted, even if they are Visa® or MasterCard® branded.

If you or your office will be paying for the testing, please contact us ahead of time and let us know so that those arrangements can be made.

Suggest your client make an appointment, if practical

We understand that it's not always possible for your clients to schedule appointments, especially if they are proceeding directly from the courthouse to our office for testing. But if it is possible for appointments to be made, we strongly encourage your clients to do so.

Please keep in mind that some tests require an appointment. Before sending your client in for testing, we recommend that you look up the service on our website or contact our office to determine if an appointment is required or not.

Ensuring that your client makes an appointment before arriving for testing will allow the collection site time to make sure that everything needed for testing to be completed is in order. This includes making sure that we have a copy of the court order, if there is one. If there is an order, but we don't have a copy of it, it allows us to get information from the donor making the appointment that can help us get copies of that order.

If there is no order, making an appointment allows us to discuss with the donor the test that they will be performing so that there are no surprises when they arrive.

Appointments also allow us to put your clients at ease. For many, taking a drug test, paternity test, or any forensic or laboratory test in connection with a legal proceeding can make people anxious, even if they feel they already know what the outcome will be. By having your clients make an appointment, we will have the opportunity to speak with the donor, answer any questions they may have, and reassure them that we don't judge anyone who walks through our doors, regardless of the reason.

Appointments can be made by calling our office during regular business hours at (636) 916-0050. Appointments can also be made online. Having donors call our office for appointments is preferred, since it gives us an opportunity to talk with the donor. Online appointments do allow the donor to ask questions, but often times we aren't able to respond to the donor immediately.

Transmit all orders for testing and other pertinent information to us immediately

If your client is performing testing because of a court order, we strongly encourage you to transmit that court order to our office immediately. By sending the order to us prior to your client appearing for testing, we are able to review it and address any issues we may see.

We also encourage you to send any additional information that you may think will assist us in ensuring the testing is completed correctly and that the experience is as quick and easy as possible for your clients. Some things you may consider sending us if it is not already included in a court order:

  • Contact information for all attorneys, GALs, and parties involved. This would include names, addresses, phone numbers, fax numbers, and email addresses. This helps us know who should receive results and how to get the results to them.
  • If there are restraining orders between parties, or if there is any safety concern that opposing parties may pose to each other, our staff, or our other clients so that we can schedule testing appropriately.
  • If a donor has an identical twin, or a relative or friend that has a very similar appearance as the individual that should be testing so we can take extra steps to verify the person's identity.
  • Any other information you feel may assist us in the testing process.

Sometimes your client may have questions about the test they need to take or want to know how to contact our office, get directions, schedule an appointment, or just do their own research. The best way to help put their mind at ease is to talk with your client and answer any questions that you can, provide them with the information they are asking for, and reassure them that you are there to help.

In addition to speaking with your client about any concerns or questions they may have, you should also direct them to visit our website. Our website has a wealth of information for donors that your clients may find extremely valuable. In addition to providing information they may be looking for, it can also put their mind at ease by allowing them to become familiar with the information they are looking for on their own time. You may spend 30 minutes explaining what test they will be taking and answering questions they have, but in the moment, they may be so distracted and anxious that they may not remember all the information you have given them. Our website can help them fill in those gaps on their own.

When should you expect test results?

When you receive test results depends on a few factors:

  • The type of test performed
  • What day of the week the test was performed
  • If your client is taking prescription medications
  • The method by which you chose to receive the results

You can visit a specific service's page to see the general amount of time it takes for results to be reported.

Some tests require an interview with a Medical Review Officer. A Medical Review Officer, or MRO, is a specially trained doctor whose job it is to review laboratory test results and compare them with any prescription medications that may be taken by the donor. If your client is taking a prescription medication, you should make sure they are aware that a doctor may be contacting them to discuss their test result. Your client may be asked to provide prescription information to the doctor, so they should have that information readily available until the result is reported. If the donor fails to answer the phone when the MRO calls, or the donor doesn't call the MRO back, the result can be delayed 7 to 10 days or until the MRO is able to get in touch with the donor.

Once we receive results, they are reported to all attorneys and clients at the same time using the reporting method requested.

Do not accept copies of test results or documents from your client

If your client or opposing counsel claims to have received their test results or a document from our office, but you haven't received it, it may be tempting to ask them to simply forward a copy to you. However, we strongly recommend that you not accept test results or documents that are given to you by anyone other than our office. Instead, we recommend that you contact our office to request that the information be sent directly to you.

While most clients will provide their counsel with a legitimate copy of a result or document when asked, we have noticed an increase in the number of attorneys receiving altered and outright fabricated test results and documents from their clients. Some have even gone as far as purchasing a website domain similar to ours and emailing results from that domain. Unless you receive the result from our office, you shouldn't accept it.

Some signs that a result or document may be fraudulent:

  • The result or document was emailed from an email address with a domain other than "asuretest.com"
  • The result or document has different font faces or font sizes in places that seem out of place
  • The result or document is an image file and not a PDF
  • The result or document has odd looking "artifacts" in places, such as thin, light straight lines that appear out of place

While the presence of these don't necessarily mean a document has been forged, they are some of the more common indicators. If you feel like something is wrong with the result or document you received, or you just want to verify its authenticity, you can forward a copy to legal@asuretest.com or call our office with your concerns or questions.

If you need help interpreting test results

Some things to consider when reviewing test results:

  • While laboratory drug screens may show a quantitative value for positive results, it's not possible to determine how much of a drug a person used, how often they used it, or when it was last used.
  • Some states have legalized medical marijuana but have not provided a method for Medical Review Officers (MROs) to validate claims of a prescription. In these instances, the MRO will release the result as positive but will include a notation indicating that the donor claims a marijuana prescription.
  • Some drug test results may be incomplete if the sample was insufficient, or the test was positive for multiple drugs. In these cases, additional samples can be taken and retested to fill in for the incomplete portions of the test. It's a good idea to request that your clients not alter any samples they have provided for testing until all test results come back. This would specifically include refraining from cutting hair or trimming finger or toenails.
  • Paternity test results will never show a result of 100%. The results are typically in the range of 90% or higher if the alleged father is confirmed as being the biological father, and 0% if the alleged father is excluded from being the biological father.
